The Senate passed its version of the Department of Defense (DoD) Appropriations bill (H.R. 3222), which included a provision by Sen. Lindsey Graham (R-S.C.) to set aside $3 billion for border security, but the House-Senate negotiators, under guidance from the House Democratic leadership, removed the $3 billion in conference.
Please fax your Republican representative and decry the removal of the $3 billion in border security funds. Express outrage at the House Democratic leadership's role in removing the funds from the DoD bill.
Background
Sen. Graham sponsored the amendment to the DoD bill with Sen. Jon Kyl (R-Ariz.), which would:
- Provide funding to construct 700 miles of fencing;
- Provide funding to procure Unmanned Aerial Vehicles (UAV), ground sensors, and vehicle barriers;
- Increase the ability to detain illegal aliens who overstay their visas and commit other crimes; and
- Provide funding for states and localities that undergo training to assist the Federal government in enforcing immigration law.
The Senate voted in October to attach the $3 billion in funding to the DoD bill by a vote of 95 to 1.
Senators Graham, Saxby Chambliss (R-Ga.), Jim Demint (R-S.C.), Judd Gregg (R-N.H.), Johnny Isakson (R-Ga.), Jon Kyl (R-Ariz.), Mel Martinez (R-Fla.), Jeff Sessions (R-Ala.), and Elizabeth Dole (R-N.C.) held a press conference on November 7 to decry the removal of the border security funding from the DoD bill.
“It is outrageous that the leadership yanked this critical funding from the final bill,” Senator Dole said, “The Senate spoke loud and clear on this issue, and now a select few have decided to ignore the number one lesson learned from the Senate’s failed immigration bill – that Americans simply don’t have confidence that their government is serious about securing our borders and enforcing our laws.” |

I don't think we've ever seen an effort like this to stop illegal immigration -- 90 politicians putting Party politics aside to finally try to resolve a terrible problem.
The tough SAVE Act (H.R. 4088) that we've been preparing you for was finally made public this week. This email will show you a number of ways that this represents a special opportunity.
For starters, here's what the nation saw revealed at the press conference:

Most bills are introduced with only a handful of original co-sponsors. The splash of co-sponsors on H.R. 4088 is really quite extraordinary.
Of the 435 Members of the U.S. House, 20% were original signers.
NEWLY ELECTED FRESHMEN ESPECIALLY EAGER TO BE SEEN AS LEADERS AGAINST ILLEGAL IMMIGRATION
- 42.5% of freshman Democrats signed
- 41.6% of freshman Republicans signed
It is clear that doing something about illegal immigration was a promise made to voters by most candidates a year ago who defeated incumbents or who won seats vacated by retiring Congressmen.
This crop of freshmen from both Parties has a much greater sense of urgency about the immigration issue than do the top leaders of their Parties.
These freshman Representatives want to become SOPHOMORE Representatives after next fall's elections.
And they know that means they at least have to be seen as having done what it takes to get some immigration enforcement passed.
- 52% of Democrats who defeated a Republican incumbent last year are original co-sponsors
And remember that this is just the beginning.
Now that the bill and its original signers have been made public, we can expect to see many more Members co-sponsoring -- especially if the users of NumbersUSA continue to fax and phone to pressure them.
Those of you responding to our Alerts the last two weeks have sent tens of thousands of faxes and made thousands of phone calls to Members informing them of the details of H.R. 4088. Please don't stop faxing/phoning if your Representative isn't on the list of original co-sponsors.

UNUSUAL COALITION
FOR ENFORCEMENT-ONLY BILL
CREATES WIDE BUZZ
I was visiting with a Republican U.S. Senator and his staff in the Capitol this afternoon. They were in mild shock at what they were seeing over on the other side of Capitol Hill in the House of Representatives.
The first thing they said about the SAVE Act by Rep. Heath Shuler (D-N.C.) was that they couldn't remember a controversial bill being introduced in the House with a lot of co-sponsors that were divided nearly 50-50 between Parties. Generally, "bi-partisan" means a lot of co-sponsors from one party and a couple from the other. Or just a handful evenly divided. "What's going on over there."
Similar points were made on Lou Dobbs as he extolled the introduction of the SAVE Act to his prime time TV audience:
DOBBS: "A large group of Republicans and Democrats are now putting border security first. And they're doing it without amnesty. This is the truth. Honest. ..."
REP. CIRO RODRIGUEZ (D-TEXAS): "This team says it is now time to finally give the people what they've asked for in immigration and that is a bipartisan effort that addresses the issue and puts America's future first and puts partisan politics on the back row where it belongs. ... "
DOBBS: "I don't know about other folks, but when I hear 'bi-partisan' these days, I reach for my wallet and start looking for a fox hole. Is this the real deal?"
REP. HEATH SHULER (D-N.C.): "It really is, Lou. I mean, we've worked really hard together. It's been a six to seven-month bi-partisan relationship where we've been able to work with Members on both sides, ask law enforcement, ask the Border Patrol agents what is important for them. And most importantly is listen to the American people and ask them what they want. We've been able to put a very good bill together. 46 Republicans and 44 Democrats.
"In fact in this town, four of the opposite party or seven of the opposite party makes it bi-partisan. This is 40 and 40. This is a package you haven't seen."
DOBBS: "No. And I haven't seen much in the way of border security that's not attached to amnesty. ... "
Our Capitol Hill Team is finding that most of the Republicans who have not yet signed onto this bill have been slowed down by caution from House Republican leadership. The House GOP leaders feel that other enforcement bills introduced this year solely by Republicans are tougher, especially in terms of local arrests and detentions. But it is highly unlikely that any of the GOP bills can be pushed onto the House floor for a vote before the next elections.
GOP leaders also are questioning signing onto the Shuler bill alongside a lot of Democratic freshmen whom they have hoped to defeat next year, in part because they aren't tough enough against illegal immigration.
You will want to push your Republican non-signers into co-sponsoring the Shuler bill by putting the improvement of American communities ahead of partisan advantage.
As for Democrats, your Capitol Hill Team is hearing that talk about the Shuler bill is spreading through the Members like wildfire, causing a lot of fence-sitting Democrats to consider appeasing their louder and louder constituents by signing onto this bill.
After being crushed by hostile phone and fax from constituents for several years, many of these Democrats are being tempted to do something popular on immigration with this bill which they consider more moderate than previous enforcement bills that have come before them.
Your pressure on your Democratic Representatives may create just the right amount of extra rationale for Democratic leaders in the House to waive aside their preference for amnesties and allow this enforcement bill to get a vote.

Senate Republicans are blaming House Democrats for stripping $3 billion for border security from the FY08 Defense spending bill.
As has repeatedly happened in the six years since Sep. 11 terrorist attacks, some part of Congress votes overwhelmingly (in this case the Senate) to provide sufficient funding to largely bring order and security to our borders. Then, the money gets pulled. Individual Members of Congress can claim when running for re-election that he/she has voted for these huges border funds, even though little ever actually gets through.
"What happened with this legislation is exactly why Americans don't have confidence in the U.S. Congress," said Sen. Jeff Sessions, R-Ala.
Sen. Lindsey Graham (R-S.C.) said the extra $3 billion would cover completion of 700 miles of border fencing and 300 miles of vehicle barriers. It also would pay for 23,000 more Border Patrol officers and increase the number of beds available to detain illegal immigrants to 45,000. It would also pay for 105 ground-based radars and surveillance towers along the border, along with four new unmanned aerial vehicles to patrol the U.S.-Mexico border.

When a bipartisan group of House members unveiled a tough immigration initiative earlier this week, eight freshman Democrats stepped forward to speak.
The bill -- the "Secure America though Verification and Enforcement Act" -- would require all employers to verify citizenship for not only all new employees but existing ones.
That approach won the endorsement of Rep. Brian Bilbray, R-Calif., chairman of the House Immigration Reform Caucus, who credits anti-immigration sentiment with his 2006 special election victory, and NumbersUSA, a group seeking to reduce immigration by making it "extremely difficult for unauthorized persons to live and work in the United States."
But the eight freshman Democrats had more immediate and local political concerns. All of them and eight more who co-sponsored the bill defeated Republican incumbents last year.
Representing states stretching from California to New York, all but one of the 16 are running for re-election in districts that gave President Bush at least 51 percent of the vote in 2004 and in which immigration is a hot issue.
Being tough on illegal immigration is not what voters look for in the northern Manhattan district of House Ways and Means Chairman Rangel, but it is in western North Carolina, where Rep. Heath Shuler, D-N.C., the lead sponsor on the SAVE Act, will have to defend his Asheville-based district next year against a more conservative challenger.
"Shuler's strength in his district is his ability to present himself as a socially conservative Democrat," said William Sabo, professor of political science at the University of North Carolina at Asheville.
"Immigration is an issue well suited to developing this image ... and it solidifies his appeal to the social conservative voters who dominate the district."
Rep. Jason Altmire, D-Pa., who will likely need to defeat former GOP Rep. Melissa Hart again to return to the 111th Congress, hears about illegal immigration from his constituents in suburban Pittsburgh and steel mill country.
"When I travel around western Pennsylvania, I hear as much about this issue as I do about any other, including the war in Iraq," Altmire said Wednesday in a conference call with reporters.
"And I worked on this bill simply because of its importance here."
In southeastern Indiana, where in 2004 Bush won the district with 59 percent of the vote, Democratic Rep. Baron Hill will face former GOP Rep. Mike Sodrel for a fourth straight time.
In a statement, Hill stated he is "constantly approached by constituents who have serious concerns about immigration."
To keep from losing the seat to Sodrel, Hill has focused much of his efforts on illegal immigration -- language from his immigration bill that passed the House in May was inserted into the SAVE Act.
In New York, Democratic Rep. Kirsten Gillibrand's district has areas that have voted Republican almost exclusively since the birth of the GOP, and she has been raising money for her 2008 campaign since her first day in office.
With New York Democratic Gov. Eliot Spitzer announcing in September his plan to issue driver's licenses to illegal immigrants, the issue has been one of the hot topics of discussion in her district, according to her spokesman.
And Democratic Rep. Nancy Boyda's unlikely victory last year in traditionally Republican eastern Kansas' 2nd District led to her instant placement atop the National Republican Congressional Committee's 2008 target list.
The district had sent conservative candidates to Congress since 1994, and Boyda will likely face former Republican Rep. Jim Ryun in a rematch next year.
In an interview, Boyda said it is "infuriating to many of the people of Kansas's 2nd District that there are laws on the books that we are not enforcing. Are we a country that enforces our laws or not?"

DEAR SUPPORTERS OF ATTRITION THROUGH ENFORCEMENT & SELF-DEPORTATION,
The SAVE Act by Rep. Heath Shuler (D-N.C.) has gotten another big boost with the co-sponsorship of Rep. Tom Tancredo (R-Colo.), the top congressional leader of the fight against illegal immigration for the last decade.
Tancredo is one of a growing number of Republicans who are putting Principle Over Party Partisanship in backing the Enforcement-Only bill that started with a few dozen Democrats.
Another new co-sponsor is Rep. Pete Sessions (R-Texas) who was thrown by re-districting into a head-to-head election with Rep. Martin Frost (D-Texas) earlier. Sessions defeated Frost, who was one of the House Democrats' top Party leaders, in part because Frost insisted on an Amnesty and Rewards First approach to illegal immigration, while Sessions has been one of our most steadfast allies in pushing illegal aliens to go home.
Scores of Democrats and Republicans are setting aside partisan bickering on this one issue to try to actually solve a problem that is plaguing much of America.
The courageous Democrats pushing the SAVE Act are standing up to their pro-amnesty national Party leadership and Presidential candidates.
The courageous Republicans who are signing onto the SAVE Act are setting aside partisan maneuvering for next year's elections. Here's the equation:
1. Most of the Democrats who are likely to be in competitive races next year are getting behind this bill. The freshmen Democrats, in particular, realize that if they want to be sophomore Democrats, they need to give their constituents a real solution to illegal immigration.
2. This bill may make it harder for Republicans to defeat those freshmen Democrats and regain majority of the House.
3. Why would Republicans help out on a bill like that?
That question came up in meetings of Republicans this week. The Republicans are well aware that this bill will be politically advantageous back home for every Democrat who signs onto it.
But in the end, more and more Republicans, like Tancredo, Sessions and Brian Bilbray (the current chairman of the Congressional Immigration Reform Caucus) are joining the Democrats because they are Putting Principle Ahead of Partisan Politics.
These Republicans who are serious about actually solving the illegal immigration problem know that nothing is going to get better soon unless they can find a lot of Democrats who are willing to join in the fight.
Heath Shuler's SAVE Act is the best opportunity in a very long time for that to happen.

Isn't it time to set partisanship aside and work to actually begin solving this problem and immediately bringing some relief to overwhelmed communities?
The SAVE ACT (Secure America with Verification and Enforcement)
I have updated and added several items from the description I gave you of the bill earlier in the week. Several of the changes respond to concerns and confusions that some of you wrote about through our Help Desk.
This bill (it will have no bill number until introduced) does a lot of things to protect our borders and to help with interior enforcement. (We'll provide you with a section-by-section analysis as soon as the bill is formally introduced.)
But the section that I applaud the most has to do with workplace verification. We believe that jobs are the main reason illegal aliens come here. Drying them up would seriously slow the flow of new illegal aliens. And it would start to drive perhaps as many as a million already-settled illegal aliens back home each year.
The SAVE Act would eventually require every employee in America to go through the E-Verify system. This internet system provides employers with an inexpensive, quick, and accurate way to verify that employees are not illegal aliens. The rules for use are such that no employee or employer suffers if there is a mistake in the system because there is ample time to correct errors on the employee's side and on the government's side.
Under the SAVE Act:
- Social Security Administration required to share "no-match" information with Homeland Security. This removes the basis of activist judges who have been trying to stop the Bush Administration's use of "no-match" letters to root out illegal workers whose Social Security numbers don't match other data in the Social Security database.
- Prohibits employers from deducting wages paid to illegal aliens. The IRS already knows which workers don't have legitimate Social Security numbers but won't share this information. This provision of SAVE allows that information to stay within the IRS but instructs the IRS to not allow any wages paid to these particular employees. The result will be much higher taxes for businesses that have illegal aliens on the payroll. This is a provision championed by Rep. Steve King (R-Iowa) who is the ranking Republican on the House subcommittee on immigration.
- ALL employers (no matter the size of their company) would face fines and possible criminal prosecution if they hire an illegal alien -- from the very beginning. The phase-in of E-Verify (described below) does not change that requirement for ALL businesses.
- But unlike now, employers would have to start using the E-Verify electronic verification system on their new hires. Because of difficulty in ramping up the present VOLUNTARY system to handle that much work, the mandatory requirements would be phased in.
- During Year 1, all government agencies, government contractors, plus all businesses with more than 250 employees, would have to run all NEW hires through E-Verify.
- During Year 2, all businesses with 100 or more employees would have to use E-Verify for new hires.
- During Year 3, all businesses with more than 20 employees would have to use E-Verify for new hires.
- During Year 4, all businesses with fewer than 20 employees would be added so that all businesses use E-Verify for new hires.
- Also during Year 4, ALL businessese would be required to run all their PREVIOUS hires through E-Verify.
Although in many ways it would be nice to immediately kick all illegal aliens out of their jobs all at once, it will probably be more orderly and create far less backlash and potential for the open-borders types to stop the program if we phase E-Verify in over four years.
Under phase in, the illegal alien community will feel an immediate squeeze that will start driving more of them to give up and go home, expecially those who lose their job and start looking for another one.
And each year, the squeeze will become more and more severe. Only three years after passage, every illegal alien in America who is in a job and working for a company that doesn't want to run afoul of the law will be run through the E-Verify and other procedures of the SAVE Act. Virtually all of them will be identified as illegal, and most of them will lose their jobs.
There aren't enough odd-jobs and off-the-books jobs in the underground economy to soak up even a small fraction of the estimated 7 million illegal workers in the country. Most illegal aliens will no longer find enough work to support them and their dependents, and most of them will eventually give up their lives of illegality and go home -- ATTRITION THROUGH ENFORCEMENT & SELF-DEPORTATION.
FIRST-TIME PROVISIONS TO CATCH
ILLEGAL ALIENS USING IDENTITY THEFT
All of us inside and outside government who have lauded E-Verify under its different names the last decade have acknowledged that it doesn't identify all illegal aliens.
It works with the majority of illegal aliens who are making up Social Security numbers and names when they apply for a job.
But if an illegal alien has paid the money to steal the identity of an American, or a legally present foreign national, E-Verify passes them through.
The Shuler bill is the first to address this problem and solve it.
It creates a system of detecting when the same identity is being used to hold down more jobs than are credible. In some cases, the same identity is being used by hundreds of people in hundreds of workplaces. The Shuler bill creates a notification system that roots out this fraud. We'll describe this in more detail in a later alert.
OTHER ITEMS IN THE BILL
Here are some other things the SAVE Act would do:
Increases Customs and Border Patrol agents by 8,000, utilizes new technology and fencing to secure the border, and expands specialized enforcement programs, such as the “Tunnel Task Force”
Outlines provisions for recruitment of new agents and personnel through bonuses, student loan repayments, and other financial incentives
Creates a pilot program to increase aerial surveillance, satellite, and equipment sharing between the Department of Homeland Security and the Dept. of Defense to reduce costs and save taxpayer money
Increases investigative abilities of ICE by employing more agents and increasing cooperation between ICE and state and local law enforcement, including sharing personnel, information, and equipment
Creates new infrastructure for the detention, processing and removal of illegal aliens by increasing detention facility capacity, and streamlining judicial processes
Implements a targeted media campaign to inform illegal aliens of new laws and penalties, while also informing employers of penalties for hiring illegal immigrants

GOOD WORK TODAY, EVERYBODY!
See below for a little report on how you all did in the Monday battle.
But first, let's focus on the battle on Tuesday.
This evening, we have introduced a new feature on our home page that should be the focus of all activist efforts now.
The "whip lists" of Senators will change by the hour based on how well you move Senate offices to declare their opposition to this latest amnesty.
It provides a link to a list of anti-amnesty champion Senators who have pledged to vote NO on the DREAM Act amnesty.
More importantly, the home page will be updated hourly tomorrow to show all the waffling Senators who voted NO on the Comprehensive Amnesty in June but thus far are unwilling to pledge to vote NO on this amnesty.
Those are Senators who "got it" last June and who obviously don't want their state's voters to think they are soft on illegal immigration. But for some reason, they are going squishy on us now.
Within 15 minutes of a Senator's office telling us to put him/her on the No Amnesty page, we will take his/her name off the home page.
STRATEGY FOR TUESDAY

Let's move as many Senators off the NumbersUSA home page as possible.
- If your state has waffling Senators, call them -- in DC and in your home state.
- If you have some more time, call waffling Senators from small-population states because they tend not to get enough phone calls from our side.
- Tell the waffling Senators that you are shocked to see their names on NumbersUSA's list of Senators who are declining to pledge to vote NO on the DREAM Act Amnesty. Pull talking points from lower in this email and from the Phone action notes on your Action Buffet corkboard.
- If the staffers try to tell you that their Senator is probably against the amnesty or definitely is, tell the staffer that NumbersUSA is reporting that at this minute the Senator has declined to make the pledge. Tell them that they need to call NumbersUSA to straighten that out. But also say that NumbersUSA is saying that many Senate offices are telling their voters that they probably will oppose the amnesty but are keeping their options open to still vote YES. If they want to be believed and for the massive phone calls to stop, they will need to publicly make the no-amnesty pledge to NumbersUSA or to one of our allied organizations on Capitol Hill.
- If you don't have a waffler Senator in your state, phone your Senators who are on the list of Pro-Amnesty Senators, the second list on our home page. That is the list of Senators who voted YES on the Comprehensive Amnesty in June and who are indicating they will vote YES on this amnesty. They have been blasted all summer for their anti-American worker, pro-lawlessness stance. Perhaps your phone calls Tuesday can help them decide against voting for amnesty again.
- Most Senators have not declared either way on this DREAM Act Amnesty. We need many more people on our NO list to persuade Senate leaders that this amnesty is too controversial and would just drag down all the rest of the Senate's work.

YOU ACCOMPLISHED A LOT TODAY
This was the second full day of pressure on the Senate offices. That kind of sustained activism begins to be noticed by the top staffers and eventually by the Senators themselves.
There are many, many potential amendments to the Defense authorization bill. By making the DREAM Act Amnesty amendment seem really controversial, you may be succeeding in moving it farther back on the calendar. Ideally, the Senate Democratic leaders will decide to just pull it.
An amnesty vote is still possible Wednesday but more likely later.
We need all the time we can get to build a toxic force on Capitol Hill to poison this amnesty before it can be introduced.

THREE DANGERS IN SENATE
Tell Senate offices that you are calling to ask the Senator to vote NO this week and next week on three measures that are being considered for the Defense Authorization bill or for a later bill this fall.
a. Vote NO on Amendment 2237 that would attach the Dream Act Amnesty.
b. Vote NO on any measure to increase H-1B visas and permanent greencards for foreign workers to take jobs from skilled American workers and students.
c. Vote NO on any attempt to increase H-2B visas for seasonal foreign workers to take jobs from America's most vulnerable workers.
By the way, the Defense bill is not an appropriation bill. Thus, if your opposition to including an amnesty in the bill delays passage of it, you will not be slowing down funding for our men and women in uniform.
Talking Points to Stop the DREAM ACT AMNESTY
- The DREAM Act (Amendment 2237 to the Defense Authorization bill) is a nightmare. It is a massive amnesty that extends to the millions of illegal aliens who entered the United States before the age of 16.
- There is no upper age limit. Any illegal alien can walk into a U.S. Citizenship and Immigration Services office and declare that he is eligible. For example, a 45 year old can claim that he illegally entered the United States 30 years ago at the age of 15. There is no requirement that the alien prove that he entered the United States at the claimed time by providing particular documents. The DREAM Act's Section 4(a) merely requires him to "demonstrate" that he is eligible-which in practice could mean simply making a sworn statement to that effect. Thus, it is an invitation for just about every illegal alien to fraudulently claim the amnesty.
- The alien then has six years to adjust his status from a conditional green card holder to a non-conditional one. To do so, he need only complete two years of study at an institution of higher education, including any vocational school. If the alien has already completed two years of study, he can convert to non-conditional status immediately (and use his green card as a platform to sponsor parents and other family members). As an alternative to two years of study, he can enlist in the U.S. military for two years. This provision allows Senator Durbin to claim that the DREAM Act is somehow germane to the defense authorization bill.
- An illegal alien who applies for the DREAM Act amnesty gets to count his years under "conditional" green card status toward the five years needed for citizenship. On top of that, the illegal alien could claim "retroactive benefits" and start the clock running the day that the DREAM Act is enacted. In combination, these two provisions put illegal aliens on a high-speed track to U.S. citizenship-moving from illegal alien to U.S. citizen in as little as five years. Lawfully present aliens, meanwhile, must follow a slower path to citizenship.
- It would be absurdly easy for just about any illegal alien-even one who does not qualify for the amnesty-to evade the law. According to Section 4(f) of the DREAM Act, once an alien files an application-any application, no matter how ridiculous-the federal government is prohibited from deporting him. Moreover, with few exceptions, federal officers are prohibited from either using information from the application to deport the alien or sharing that information with another federal agency, under threat of up to $10,000 fine. Thus, an alien's admission that he has violated federal immigration law cannot be used against him-even if he never had any chance of qualifying for the DREAM Act amnesty in the first place.
- The DREAM Act also allows illegal aliens to receive in-state tuition rates at public universities, discriminating against U.S. citizens from out of state and law-abiding foreign students.
- The DREAM Act also makes the illegal aliens eligible for federal student loans and federal work-study programs-another benefit that law-abiding foreign students cannot receive-all at taxpayer expense.
- A consistent theme emerges: Illegal aliens are treated much more favorably than aliens who fol¬low the law. There is no penalty for illegal behavior.
Talking Points to Prevent Attaching Provisions of the SKIL Act
- Increase the annual cap for "temporary" nonimmigrant visas from 65,000 to 115,000. But that's just the first year (after that, if the cap is met in any year, it can be further increased by 20 percent for the next year with a ceiling of 180,000 per year)
- Establishes more exemptions from the cap, thus rendering the cap virtually meaningless (as it is, approximately two-thirds of all current H-1Bs have been exempted)
- Instead of capturing "unused" EB visas (as claimed by proponents) from previous years, adds new EB visas by an amount coinciding with the number not issued in those years
- As with the H-1B provisions described above, establishes additional exemptions to the annual EB visa cap that do nothing but make it easier for U.S. employers to import cheap labor rather than hiring American workers.
- "Expedites" and "streamlines" the processing of millions of new applications (and requisite background checks) for "temporary" workers and for LPR status, which, to an agency (U.S. Citizenship and Immigration Services [USCIS>) that has shown itself to be unable to adequately implement current immigration laws, is both untenable and reckless
- Authorizes employers to propose a prevailing wage of their own choosing if the Labor Department is too swamped with labor certification applications to respond within 20 calendar days, thus allowing existing wage stagnation in high-tech fields to become further entrenched
- Allows greater abuse of the L-1 “intracompany transferee/specialized knowledge” visa, which, unlike the H-1B, may be issued without numerical limitation and without the employer being required to pay the alien employee the prevailing wage, or meet other labor condition requirements, and they are valid for longer periods of time
- Puts L-1 nonimmigrants in line for lawful permanent resident (LPR) status, which, for all intents and purposes, would make their employment permanent and would take yet more jobs away from U.S. workers
- Expands eligibility for F student visas – shown to be an effective method for terrorist elements to lawfully enter, and then remain in, the United States – to aliens wanting to study in high-tech fields and, in concert with other high-tech-related provisions, affords them the opportunity to be "fast-tracked" toward LPR status and permanent placement in the job market as more cheap, foreign labor
Talking Points to Stop Expansion of Visas for Seasonal Workers
- H-2B visas are for temporary or seasonal non-agricultural, unskilled workers. Employers who want to hire H-2B workers must obtain a labor certification from the Department of Labor (DoL) stating that qualified American workers are not available to fill the jobs. Unfortunately, the “certification” process is less certification and more rubber stamp, since DoL is not permitted even to verify the truthfulness of the information on petitions. If the employer filled in all the blanks, DoL approves the petition.
- H-2B visas were created so that employers could fill temporary labor shortages until U.S. workers can be found. Employers of H-2Bs are required to look for American workers first, but the requirements for advertising job openings are minimal. At the least, employers should be required to post job openings on an internet-based system like DoL’s “America’s Job Bank.”
- Since H-2B visas are renewable for up to three years and family members are allowed to accompany the workers, these visas often end up providing semi-permanent residency. After three years, the foreign worker and his family must go home for six months before returning for up to three more years.
- The United States economy is not facing a shortage of unskilled workers; in fact, it has an oversupply
- 14 million Americans are unable to find full-time jobs in the current economy (Bureau of Labor Statistics—BLS);
- The unemployment rate among the 12 million American adults who do not have a high school diploma is almost 9 percent (BLS);
- An astonishing 40 percent of working-age African-American men are unemployed (BLS);
- The percentage of 16- to 19-year-olds holding jobs in the United States is the lowest it has been since the government began tracking statistics in 1948 (Prof. Andrew Sum, Center for Labor Market Studies, Northeastern University).
- At least 40 percent of the illegal-alien population came to the United States on a temporary visa, like the H-2B, and then overstayed after the visa expired. Congress should not even consider increasing the numbers of temporary visas until DHS has fully implemented an entry-exit system, based on biometric identifiers, to ensure that visa holders leave the United States when their visa expires. Otherwise, Congress will simply be facilitating illegal immigration.

Our Capitol Hill Team cannot name me a single U.S. Senator that it can guarantee will vote against the DREAM Act Amnesty next week.
We feel certain that in the final analysis we will get a minimum of 20 or so, but we at this time can't give you any names because we don't know who they will be.
You all have already sent 43,212 faxes into Congress since I alerted you in the middle of the night. That's great. But it means most of you have not responded yet.
I don't want to sound like a nag, but I have to tell you that there have not been anywhere near enough phone calls into Senate offices today. We're losing.
I can tell you with great assurance that unless you pick up a phone and call, the amnesty WILL pass this next week.

Why are we losing Senators who voted NO on the Comprehensive Amnesty in June?

THE OPPOSITION PLANS TO BEAT US ON PHONE AND FAX THIS TIME
All summer since the media gave you credit for moving the Senate with your faxes and phone calls to kill the Comprehensive Amnesty bill, we have seen open borders groups telling their members that they would beat NumbersUSA at our own game this fall.
Some open borders groups said that they would be studying our NumbersUSA grassroots mobilization system carefully and would imitate it to generate more faxes and more phone calls FOR amnesty than we can AGAINST amnesty.
There have been reports of open-border billionaires so angry at the NumbersUSA success in June that they have pledged to provide enough money to the open-borders groups for them to generate more faxes and phone calls than our side.
Just one problem with all the bravura of the open-borders crowd: There are a whole lot more of us than them.
Thanks to the generosity of about 10% of you, we have the funds to pay for an avalanche of faxes over the next several days.

Friends, the business lobbies have bought off most of the Democratic leadership that is in control of the Senate in order to radically increase the importation of foreign workers and keep American wages from rising.
Because Republican party leaders have traditionally been helpful to business lobbyists, we face incredible odds in trying to stop this triple threat next week.
We stopped an amnesty for all illegal aliens in June. But these actions next week not only will provide amnesty to several million of them but is designed to soften up the politics to pass other amnesties later this fall. We must overwhelm the Senate with our opposition starting this afternoon.

What's next?
They all know that the 455,000 of you who registered to use NumbersUSA action tools to fight the amnesty are a formidable force that proved itself capable of defeating a bill -- and embarrassing the whole Establishment. What they want to know now is whether enough of you will coalesce around a positive goal to actually pass legislation.

ABOUT HALF OF YOU RECENTLY JOINED US -- Allow me to give you our broader vision of what we believe is needed in immigration policy
We cannot focus and marshall our resources and our cumulative efforts without having the larger picture of the future in mind. Here are some bedrock understandings that guide our operations:
- Overall immigration numbers are far too high and threaten the quality of life and liberties of all Americans.
- Two national commissions have found that immigration must be dramatically reduced in order to:
A. Protect our natural resources, our wildlife and their habitats, and our open spaces for human recreation and sanctuary. This was a finding of the President's Council on Sustainable Development in 1996.
B. Provide economic justice for the most vulnerable Americans in our local communities. This was the finding of the bi-partisan U.S. Commission on Immigration Reform in 1995 and 1996.
Now that there is a moment in the political calendar to take a breath, I hope you will become more acquainted with just how mainstream and intellectually respectable are your/our desires for reduced immigration.
We're talking about both illegal and legal numbers. No amount of tinkering with the composition of immigration can get us anywhere unless the numbers are cut dramatically.
Some of you may have joined this as a fight against only illegal immigration. But nearly everything you fear from illegal numbers is also happening from legal numbers that are too high. If you have any doubt, please watch our video that has been viewed in various versions more than 2.5 million times! This video shows that the magnitude of the problem is great enough to demand urgent action. Beating back amnesties is not enough.

I founded NumbersUSA in 1997 to carry out the immigration policy recommendations of those two commissions.
In May of this year, I testified before Congress, reminding that it had failed for 10 years to heed the advice of those commissions which can be summed up as (a) an end to mass illegal migration, (b) the eventual departure of most illegal aliens now in our midst (mostly by removing the jobs magnet and causing illegal aliens to voluntarily go home), and (c) deep reductions in future legal immigration.

But only now are we beginning to have a large enough group of active citizens to have hope of achieving positive changes in our immigration policies.
This citizen army came together to defeat a disastrous amnesty bill. The question now is whether you will stick with efforts to actually improve our country's future through major changes in immigration policy.

HOW WE WILL CHOOSE PRIORITY ACTIONS
FOR THIS SUMMER AND FALL
There remain major behind-the-scenes efforts to try to pass at least three parts of the defeated Kennedy/Bush Comprehensive Amnesty Bill:
1. The DREAM ACT amnesty for illegal aliens who graduate from high school and want to attend college.
2. The AG JOBS amnesty for all illegal aliens who are working in agriculture (or who can fraudulantly claim to be doing so).
3. A major increase in H-1B temporary visas primarily for foreign high-tech workers to enable more businesses to pay the lower wages of younger foreign workers and avoid higher-cost older American workers.
Our Capitol Hill Team is watching these developments closely, and we have provided some action items on your Action Buffet, based on how you have taken the Interest Survey.
But we are hopeful that the Democratic leadership in the House and Senate can be shamed into at least bringing legislation to the floor that will tackle a problem that nearly all Members of Congress agree exists.
There are two main possibilities:
(1) More money for major expansion of Border Patrol and detention space -- perhaps even for more miles of fence -- to better secure the border, and
(2) the start of a mandatory verification system for new hires.
We are in talks now with key Members of Congress and their staff who have been our allies to find whether most of us can agree on a course of action. If possible, our chances are best with a proposal that important Members of Congress are willing to champion.
That doesn't mean that citizens should stop pushing for other items as well, but we want to be certain that we throw all resources possible into actually improving the situation this year.
There are dozens of things that need to be done. But we don't want to end the year with zero progress because we tried to do everything at once and failed to push at least one positive measure into law.
I apologize if this is not as focused as you would like by this weekend. I promise that we will be giving much clearer directions soon. But I hope you can appreciate our efforts to choose distinct targets so you can use your energy and time as effectively as possible.
The border security and workplace verification goals listed above both have been embraced by most Republicans and Democrats who have both supported and opposed the various amnesty bills.
Our job will be to isolate and press with all vigor those Members who back away and say they will not secure our border and will not secure American jobs, even though they said both were necessary when they were promoting amnesty bills.
